Terms of Use
These Terms of Use (“Terms”) govern access to and use of the 100bps website (100bps.ai) and application (app.100bps.ai) (together, the “Service”), operated by Mano Maya LLC, a Wyoming limited liability company, doing business as 100bps (“100bps,” “we,” “us”).
By creating an account or using the Service you agree to these Terms. If you use the Service on behalf of a firm, you represent that you are authorized to bind that firm, and “you” includes the firm.
Paid subscriptions are additionally governed by the 100bps Subscription Agreement presented at checkout. If these Terms and the Subscription Agreement conflict, the Subscription Agreement controls for paid access.
1. The Service
100bps provides retirement-plan market intelligence for investment professionals, computed from public federal filings (including Form 5500 series filings and SEC/state investment-adviser filings). The Service is intended for use by financial-services professionals; it is not a consumer product. 100bps is a software provider — it is not a registered investment adviser, broker-dealer, law firm, or tax advisor.
2. Accounts and access tiers
- You must be at least 18 and able to form a binding contract. You must provide accurate registration information, including a valid email address, and keep your credentials confidential. You are responsible for activity under your account; notify us promptly of any unauthorized use.
- Free access (including sample “teaser” access and time-limited guest passes) is a limited demonstration, provided at our discretion, with access limits we set and may change. We may suspend, restrict, or revoke free access at any time.
- If you submit a CRD number for verification, you represent that it is your own or your firm’s, and that you are authorized to use the associated email domain.
3. License and restrictions
We grant you a limited, revocable, non-exclusive, non-transferable right to view and use the Service for your own professional evaluation and, for paid subscribers, as set out in the Subscription Agreement.
You agree NOT to:
- scrape, crawl, spider, bulk-download, or systematically extract data from the Service, whether manually or by automation;
- share, publish, resell, sublicense, or redistribute Service content (including plan lists, scores, signals, or extracts) outside your firm;
- share login credentials or allow use of your account by others;
- circumvent, probe, or interfere with any access control, rate limit, masking, watermark, or security measure;
- use the Service or its data to build, train, or improve a competing product or dataset;
- reverse engineer or attempt to extract source code, except as permitted by law;
- collect information about other users of the Service;
- use the Service to send unlawful, harassing, or unsolicited communications, or to violate any law or third-party right;
- misrepresent your identity, firm, or CRD in registration or verification.
We employ technical measures (including access controls, usage limits, and abuse detection) to enforce these restrictions, and we may suspend or terminate access that we reasonably believe violates them.
4. Intellectual property; feedback
The facts contained in government filings are public records, and we claim no ownership of them. The Service itself — including our selection, verification, computation, scoring, signals, derived metrics, compilations, software, and presentation — is the property of Mano Maya LLC and is protected by copyright, database-compilation, and other laws, and by these Terms. “100bps” and associated logos are trademarks of Mano Maya LLC; you may not use them without permission. If you send us feedback or suggestions, we may use them without restriction or obligation to you.
5. No advice; informational use only
The Service reports information derived from public filings. It is provided for informational purposes only and is not investment, legal, tax, accounting, or compliance advice, and is not a recommendation of any plan, security, provider, or course of action — including any score, signal, or brief. You are solely responsible for your own professional conduct, including compliance with all laws and regulations applicable to your outreach and advisory activities.
6. Data accuracy
Filings are self-reported by plan sponsors and processed at scale; certain data (for example, fund lineups) is extracted from filing attachments by automated means. Independently verify information before acting on it.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ACCURACY, COMPLETENESS, TIMELINESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FILING DATA REFLECTS THE PERIODS FILED, WHICH NECESSARILY LAG THE PRESENT.
7. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MANO MAYA LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATING TO THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE (OR ONE HUNDRED DOLLARS ($100) IF YOU HAVE PAID NOTHING). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME MAY NOT APPLY TO YOU.
8. Termination
You may stop using the Service at any time. We may suspend or terminate access (including free access) at any time for violation of these Terms or to protect the Service, with notice where practicable. Sections 4–7 and 9–10 survive termination.
9. Changes
We may update the Service and these Terms. Material changes will be posted with a new effective date (and, for material changes affecting account holders, notice by email or in-app); continued use after the effective date is acceptance.
10. Governing law; general
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. Exclusive venue for disputes is the state or federal courts of Wyoming, and each party consents to their jurisdiction. These Terms are the entire agreement regarding free use of the Service and supersede prior agreements on that subject. If any provision is unenforceable, the remainder stands; failure to enforce is not waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale of the business.
